Important Information
The National "Do Not Call" legislation became effective October 1, 2003. As discussed in UA News magazine (page 8, August 2003 issue), this Do Not Call Registry is a list of phone numbers from consumers who have indicated their preference to limit the telemarketing calls they receive. In basic terms, and with some limited exceptions that are discussed below, if an individual's telephone number appears on the National Do Not Call Registry, then the law prohibits telephone solicitation calls to the registered telephone number.
Note that the law creating the National Do Not Call Registry prohibits telephone solicitation calls to specific telephone numbers. That is, if a telephone number is listed on the Registry, then no one may place a telephone solicitation call to that telephone number. Failure to comply with Do Not Call law can result in fines of up to $11,000 per violation. Each call may be considered a separate violation. Compliance with these regulations is crucial.
There are three parts to the Do Not Call legislation:
- National — The National Registry is sponsored by the Federal Trade Commission (FTC) and the Federal Communications Committee (FCC) and has jurisdiction over nearly all sales calls placed to U.S. consumers.
- State — Over half of the States currently administer their own Do Not Call Registries. The National law does not preempt State law, so Agents who do telemarketing must check with the various states in which they operate to determine what is required for compliance at the State level. - Company — The Company is required to maintain a database or registry of names of people who have instructed us to remove them from our telemarketing lists.
Established Business Relationship:
It is important to recognize that the National Do Not Call provisions may not impact companies with which a consumer has an established business relationship. Even if a consumer's telephone number is in the National Do Not Call Registry, if a company has an established business relationship with that consumer, then the company may place a telephone solicitation call to the registered number. For our purposes an "established business relationship" is limited to the following:
- Lapses - A lapsed United American policyholder whose last premium payment occurred within the past 18 months is considered to have an established business relationship with United American.
- Inquiries - An individual who has made an inquiry or request for information within the past three (3) months is considered to have an established business relationship with United American.
- Active Policyholder - An active policyholder has an established business relationship with United American.
Internal Company Registry:
The National Do Not Call provisions require all companies to maintain an internal Do Not Call Registry. Even if a company has an established business relationship with a consumer, if that consumer specifically requests the company not to contact him or her again, then the company is required to place the consumer's telephone number on the company's internal Do Not Call Registry. The company may not contact the consumer again. If you are an independent General Agency and you represent multiple companies, under the National DNC provisions you would be required to also maintain your own internal DNC registry for those persons who request not to be called.
Handling Do Not Call Requests:
United American maintains an internal Do Not Call Registry. If an Agent or appointment setter makes contact and someone requests not to be called again, that information must be sent to the Home Office (via e-mail, letter, or phone) to the attention of Policy Service. In order for the individual's telephone number to be added to our internal Company Do Not Call Registry, you will need to provide the date of the request, full name, phone number, policy number (if applicable) and address, if available, for anyone to be added.
Your Responsibility When Buying Lists:
- If you intend to market by telephone or mention United American Insurance Company anywhere in your sales approach (phone script, appointment setting, etc.) and you purchase a list of names and telephone numbers from an outside vendor, you must submit your purchased list to UA to be scrubbed against United American's Do Not Call database. The list must be a delimited ASCII text file format and must be submitted to the Home Office in either of the following methods:

- Any list you purchase can only be used for three months from the date it was scrubbed. You must then have the list scrubbed again.
- It is your responsibility to ensure any list you purchase and/or use has been scrubbed against any applicable State list.
- It is the General Agent's responsibility to notify any new and existing sub-agents (Writing Agents), or any Agents contracted through his/her Agency, of the Do Not Call rules and train them accordingly.
How Does The Do Not Call Legislation Affect...
Referrals: If you receive a referral, you must scrub that telephone number against the National, State and Company Registries prior to telephoning the referral.
Setting appointments/Sales Calls: If you are using a list to call prospective customers to set up appointments or to talk about their insurance needs, you must run your list against the National, State and Company Registries prior to telephoning them.
Autodialers: The Do Not Call Registries apply to telephone solicitation calls made by autodialers. You may not telephone customers who have placed their name on the National, State or Company Do Not Call Registries.
